Q02Can a minor be charged as an adult in Illinois?
Yes. Illinois allows discretionary transfer of minors 13 and older for certain felonies, and mandatory or presumptive transfer for older minors charged with serious offenses such as first-degree murder, aggravated criminal sexual assault, and certain weapons offenses. Q03Does my child need a lawyer if the school is just questioning them?
Yes. Statements made to a school resource officer or administrator can be — and routinely are — used in subsequent criminal proceedings. A minor has the same Fifth Amendment rights as an adult and should not be questioned about potentially criminal conduct without counsel present and a parent's knowledge.
Q04What is a station adjustment?
A station adjustment is an informal resolution by the arresting police agency, with no court filing. It can carry conditions (counseling, restitution, curfew) but does not produce a delinquency adjudication. For appropriate cases, a station adjustment is the best possible outcome and the firm advocates for it where the facts allow.
Q05Do parents attend the court hearings?
Yes. Parents and guardians are required to attend juvenile court proceedings and play a defined role at the dispositional phase. The firm prepares the family for what to expect at each stage and communicates regularly with parents about strategy and progress.
